2025 Freshness Sale Terms
Why do we do a sale? Because we believe fresh is best! At Lush we have a Freshness policy showing our commitment to selling the freshest cosmetics and being transparent so you’ll always know when something was made.
Please note that this Sale has been extended. See clause 2 for details.
1. These terms and conditions (the “Terms”), together with other relevant LUSH terms and conditions found at https://www.lush.com/uk/en/faq/terms-and-conditions (“Standard T&Cs”) apply to the Freshness Sale 2025 (the “Sale”). By making a purchase from the Sale online or in store, you agree to be bound by these terms and conditions. It is a condition of purchase from the Sale that all Terms and Standard T&Cs are accepted as final. In the event of any dispute regarding the Terms or the conduct of the Sale, the decision of LUSH shall be final, and no correspondence or discussion shall be entered into.
2. The sale will begin on the 26th December 2025 in all LUSH stores, on the LUSH website and on the LUSH app, and will end on the earlier of (1) Monday 9th February 2026; and (2) when we have run out of the selected stock (“Promotion Period”). We reserve the right to extend the Promotion Period at our sole discretion, details of any extension of the Promotion Period will be communicated via the LUSH app and website and by email.
3. The sale is on a ‘first come first served’ basis and subject to availability whilst stocks last.
4. The products to be included in the Sale shall be at our sole discretion and we make no guarantee as to the type or availability of any of the products included within the Sale, although we hope to include as many of your favourite festive treats and other popular products as possible. Products included in the Sale will be clearly marked in-store or will be found on the relevant promotion page on the LUSH app and website, with the discount also indicated on the product page.
5. All stock will be sold in line with our bulk buying policy to ensure products are for personal use and not for resale.
6. Due to the increase of orders received during the Sale and stock availability of Sale products, delivery options for purchases including Sale products made on the LUSH app or website are restricted to only standard delivery to an address or a LUSH store of your choosing. Free delivery, next day delivery and Click & Collect will not be available options for deliveries including Sale products and your selected delivery option is subject to delivery restraints of that service during the Sale period. For this reason, orders may fall out of the delivery times quoted in our Delivery Information page of our website. You shall not be entitled to a refund of any delivery fees in the event your order is not delivered within these timeframes.
7. We hope you are thrilled with your purchases. However, in the case of a faulty Sale product, we unfortunately may be unable to replace sale items due to limited stock. If we cannot offer you a replacement, Customer Care will be able to offer a full refund of the price paid by you on any faulty Sale products or errors that occur from online, app or in-store purchases.
8. If you have purchased online or on the app, and simply changed your mind, you have the right to a refund of the amount you paid for the returned product if the product is returned within 14 days of purchase in its original condition with the corresponding receipt. For more information on refunds, please refer to our Standard T&Cs. This does not affect your statutory rights.
9. Some of the products in the sale are nearing the end of the time frames set out in our Freshness Policy (this is not the same thing as their best before date). It’s possible that a few of the items you purchase won’t be as fresh as our full-priced items and we think it’s important you’re aware of that now before receiving them.
10. Sale discount cannot be used in conjunction with any other online, in-app or in store offer or promotion (this includes but is not limited to the £3 Lush Club welcome credit, any other customer discounts and any staff discount) unless stated. Lush Club members who are participating in the Lush Club Rewards Customer Loyalty Programme can still earn rewards points on their purchases of Sale products and can still redeem rewards which are complimentary products with purchases of Sale products as long as they meet all requirements in the programme’s terms and conditions (https://www.lush.com/uk/en/a/lush-club-rewards-programme-uk-terms-conditions).
11. The discount is applicable against the gross value of the product. This includes VAT where applicable.
12. Where any of these Terms conflict with our Standard T&Cs, these terms and conditions shall prevail in relation to the purchase of any Sale products.
13. We reserve our right to withdraw or amend this offer at any time without prior written notice and at our sole discretion.
14. You explicitly acknowledge and accept the prohibition on commercial resale set out in our Terms and Conditions.
15. Limitation of Liability
a. Subject to clause 15(b), LUSH and its group companies accept no responsibility for any damage, loss, injury or disappointment suffered by any person as a result of their participation in the Sale, their attempted participation or their acceptance of any product.
b. Nothing in these Terms shall exclude LUSH’s liability for death or personal injury as a result of its negligence, or for fraud or fraudulent misrepresentation, or for any other liability which may not be lawfully limited or excluded under English law.
c. By participating or attempting to participate in this Sale, participants agree that LUSH shall not bear any liability for: the loss, theft or misuse of any product; or any damage in any way attributable to this Sale or the attempted participation in this Sale, subject to clause 15(b).
16. Any failure on any occasion by LUSH to enforce a Term is not a waiver of that Term.
17. The Sale and these Terms will be governed by English Law and, subject to any right you may have as a consumer to select jurisdiction, any disputes will be subject to the jurisdiction of the Courts of England and Wales. The Sale and any location on which these Terms are posted are only intended to be accessed from Great Britain, and Northern Ireland. LUSH does not make any representation that materials relating to the Sale are appropriate or available for use at other locations. Access to them from territories where their contents are illegal is strictly prohibited. If you view these Terms from territories other than England, Scotland, Wales, or Northern Ireland, you are responsible for compliance with all local laws.
