    1. About these terms

    1.1 What these terms cover.

    These are the terms and conditions (“LUSH Wallet Terms”) that govern our digital store credit wallet in New Zealand (“LUSH Wallet”).

    1.2 Why you should read them.

    Please read these LUSH Wallet Terms carefully before you activate a LUSH Wallet. They explain who we are, how LUSH Wallet works, how we may change or end the LUSH Wallet feature, and other important information. By accessing or using the LUSH Wallet feature, you warrant that you have read, accept and agree to the LUSH Wallet Terms. We reserve the right to change the LUSH Wallet Terms at any time by publishing updates on its website, and may provide you with a notice of the update to you registered email address. By continuing to use your LUSH Wallet you agree to be bound by the changes to the LUSH Wallet Terms. If you do not agree with the LUSH Wallet Terms you must not use a LUSH Wallet.

    You acknowledge and agree that The LUSH Wallet Terms are to be read in conjunction with any terms and conditions in place from time to time that apply to any account you hold with us (“LUSH Account”), as well as any terms of use in place from time to time relation to our website and the LUSH App. In so far as it is relevant, those terms and conditions are incorporated into the Lush Wallet Terms and will prevail over the Lush Wallet Terms to the extent of any inconsistency.

    You also acknowledge and agree that our Privacy Policy applies to our use of your personal data in relation to the LUSH Wallet and is incorporated into and forms part of the LUSH Wallet Terms.

    1.3 Additional terms.

    Additional terms may apply to special offers (“Promotions”) available to LUSH Wallet users. Any such additional terms will be displayed on our website or made available in-store. Please read them carefully.

    2. Information about us and how we may contact each other

    2.1 Who we are.

    We are Lush (New Zealand) Limited (‘Lush’) (NZBN 9429038140211) our Registered Address is Unit A 162 Foundry Road, Silverdale Auckland New Zealand 0932. (“We” or “Us” or “Our”).

    2.2 How to contact us.

    2.3 How we may contact you.

    We may contact you using the email address you provided when registering for your LUSH Account. Please keep your contact details up to date.

    3. Eligibility for LUSH Accounts and LUSH Wallet

    3.1 Wallet availability.

    To activate a LUSH Wallet, you must hold an active New Zealand LUSH Account and the LUSH Wallet feature must be available in New Zealand.

    3.2 Eligibility.

    To register for a LUSH Account you must:

    a. be a New Zealand resident;

    b. be at least 18 years of age; and

    c. have a valid email address.

    3.3 One account per person.

    You may only hold one LUSH Account (and one linked LUSH Wallet) per person.

    3.4 Personal use only.

    LUSH Wallets are for personal, non-commercial use.

    4. LUSH Account Terms

    4.1 How to register

    You can register via www.lush.com/nzor the LUSH App. You must provide your full name, valid email, and any required information.

    4.2 Keeping information up to date

    You are responsible for ensuring your LUSH Account details are accurate and current. 

    Should any of your information change, you must immediately update your information by signing into your LUSH Account and making the necessary updates and or changes.

    4.3 Passwords and security

    You are solely responsible for keeping your password confidential and secure. You are responsible for all activities conducted under your account. You must notify us immediately of any unauthorised use of your Account, your Credentials, or any other breach of security.

    4.4 Losses due to misuse

    We are not liable for losses resulting from unauthorised access or misuse of your LUSH Account.

    4.5 Cancelling your LUSH Account

    You may delete your account via your online profile or by contacting Customer Care. Cancelling your account will remove access to your LUSH Wallet and any stored credit.

    5. LUSH Wallet Credit

    5.1 Activation

    You can activate your LUSH Wallet in the LUSH App if you hold a New Zealand LUSH Account. Wallet balances are held in New Zealand Dollars (NZD). No activation or maintenance fees apply.

    5.2 Adding credit

    You can add credit to your LUSH Wallet (“LUSH Wallet Credit”) by:

    • redeeming “Bring It Back” rewards in-store;

    • participating in Promotions;

    • purchasing LUSH Wallet Credit using a valid payment method or LUSH Gift Card.

    5.3 Bring It Back rewards

    You can opt to have your “Bring It Back” rewards added directly to your Wallet balance in-store, provided you can access your LUSH Account at the time. To access the “Bring it Back” Reward you must read, accept and agree to the “Bring It Back” Terms in place from time to time.     5.4 Promotional credit

    From time to time, we may issue promotional Wallet Credit for specific campaigns. Additional conditions may apply and will be displayed where relevant.

    5.5 Gift Cards

    You may use a New Zealand LUSH Gift Card to purchase LUSH Wallet Credit (in full only, not partially). This is subject to the Gift Card Terms and Conditions.

    5.6 Payment methods

    You may add funds using any payment methods accepted in New Zealand. Wallet balances will be updated after successful payment.

    5.7 Refunds and Cooling-Off Period

    If you purchase LUSH Wallet Credit online, you may cancel within 14 days unless the balance has been used. Any refunds will be in accordance with the Consumer Guarantees Act (CGA) 1993 and the Fair Trading Act 1986 (FTA).

    5.8 Returns

    If you return a purchase paid for using LUSH Wallet Credit, the refund will be applied back to your LUSH Wallet, in accordance with our Returns and Refunds Policy in place from time to time. Our current policy can be found at https://www.lush.com/nz/en/faq/terms-and-conditions-directory-nz

    5.9 Spending Wallet Credit

    • You can use your Wallet Credit in New Zealand LUSH stores or the LUSH App.

    • Wallet Credit cannot be used for non-LUSH products or exchanged for cash.

    • Wallet Credit has no expiry date.

    • From time to time, Wallet Credit may be excluded from specific promotions (e.g. limited releases or sales events).

    6. Wallet Balance and Limits

    6.1 Credit limit

    You may not hold more than NZD $1000 in your LUSH Wallet.

    6.2 Daily spend limit

    You may not spend more than NZD $500 per day using your LUSH Wallet.

    6.3 Checking your balance

    You can check your balance and transaction history in the LUSH App or via your online LUSH Account.

    7. Access and Security

    7.1 No monetary value

    Wallet Credit has no monetary value and cannot be exchanged for cash or interest. It is not a credit or deposit account or a financial product.

    7.2 Unauthorised transactions

    If you suspect unauthorised use, contact us immediately. We may correct your balance in cases of proven error.

    7.3 Fraud or misuse

    We reserve the right to suspend or close accounts suspected of fraudulent activity or misuse.

    8. Termination

    8.1 By you

    You can close your LUSH Wallet at any time by contacting Customer Care. You must spend your balance before closure, as any remaining funds will be forfeited.

    8.2 By us

    We may close your LUSH Wallet if it’s misused or inactive. If the LUSH Wallet service is discontinued, we’ll give at least 6 months’ notice. You can spend your balance or convert it into a LUSH Gift Card before closure.

    8.3 For breach

    If we believe you are acting in breach of these Terms (for example, using multiple accounts or commercial use), we may close your account immediately without notice.

    9. Data Protection

    We collect and process your data and personal information in line with our Privacy Policy and the Privacy Act 2020.

    We use your personal data to administer your LUSH Account and Wallet, and to assess eligibility.

    10. Marketing Communications

    When you activate your Wallet, you can choose whether to receive LUSH Wallet updates via email. You can change your preferences anytime via your LUSH Account.

    11. Liability and Governing Law

    11.1 Liability

    You acknowledge and agree that use and acceptance of the LUSH Wallet is at your sole risk.

    By using and accessing the LUSH Wallet, you indemnify us against any and all actions, claims, damages, expenses or liabilities suffered or incurred directly or indirectly by us in consequence of any breach or alleged breach, non-performance or non-observation of any agreement, conditions, obligation or warranty on your part. You hereby waive and release us and each of our parent, affiliated, subsidiary and/or related entities and parties from any claim, action or demand arising out of or in connection with your use and access of the LUSH Wallet.

    To the maximum extent permitted by law, we are not responsible for any damage or loss suffered by you where such damage or loss was not a reasonably foreseeable consequence of a breach of these LUSH Wallet Terms, or where the LUSH Wallet does not run as planned.

    To the maximum extent permitted by law, we will not accept responsibility for equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind. 

    To the maximum extent permitted by law, we will not be held responsible for the failure to fulfil the obligations of third parties involved in the LUSH Wallet, although we will always endeavour to minimise the effect to the participants of any such failure.

    To the maximum extent permitted by law, we will not accept responsibility for any liability arising in connection with any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

    To the fullest extent permitted by law, we, including our officers, employees, agents and contractors, disclaim all warranties and representations of any kind (whether express or implied) and will not be liable for any direct or indirect damage (including special and/or consequential damage, such as loss of business, loss of profits or loss of data) which results from use or access of your LUSH Wallet.

    Without limitation to the foregoing, we acknowledge that the laws in New Zealand may imply warranties and conditions or impose obligations on the supply of goods and services which cannot be excluded, restricted or modified except to a limited extent. If any such laws apply, then to the fullest extent permitted by the law and to the extent permitted by the Consumer Guarantees Act (CGA) 1993 and the Fair Trading Act 1986 (FTA) we limit our liability and if any liability remains it will be limited to any one or more of the following in its sole discretion:

    • in the case of any goods, the replacement or repair of the goods, or the supply of equivalent goods, or the payment of the cost of repairing or replacing the goods or supplying equivalent goods; and
    • in the case of any services, the supply of the services again or the payment of the cost of having the services supplied again.

    11.2 Governing Law

    These Terms are governed by the laws of New Zealand. Any dispute will be handled by the courts of New Zealand, unless otherwise required by law.
