Lush Canada – Factory Freshness Sale 2025 Terms and Conditions

1. These Terms and Conditions (“Sale Terms”) apply specifically to the Lush Factory Freshness Sale 2025 (the “Sale”). By making a purchase from the Sale, you agree to be bound by these terms and conditions.

2. It is a condition of purchase from the Sale that all Terms are accepted as final.

3. By participating in the Sale, you also agree to be bound by our standard Terms and Conditions set out at https://www.lush.com/ca/en_ca/faq/ca-terms-of-use (“Standard T&Cs”). If there is a conflict between these Terms and our Standard T&Cs, these Terms will take priority in relation to the sale of products.

4. In the event of any dispute regarding the Terms or the conduct of the Sale, the decision of Lush shall be final, and no correspondence or discussion shall be entered into.

5. Sale Period and Location:

The Sale will take place at the designated Lush Canada factory location(s), as advertised by Lush, on Saturday, October 18, 2025 from 9:00 a.m. to 3:00 p.m. (local time) and on Sunday, October 19, 2025 from 9:00 a.m. to 3:00 p.m. Lush may shorten, extend, or cancel the Sale period at its discretion.

6. Product Availability

Products offered in the Sale are selected by Lush at its sole discretion. All items are sold on a first-come, first-served basis while quantities last. If products sell out on the first day, Lush may elect not to proceed with the Sale on the second day. Lush does not guarantee the availability of any specific product or product type.

7. Purchase Limits

To ensure fairness, customers may purchase a maximum of seventy five (75) units in total. Additional limits may apply. Lush reserves the right to refuse transactions that appear to be for resale, distribution, or other commercial purposes.

8. Pricing and Discounts

Sale products may be offered at discounts of up to sixty percent (60%) off the original retail price (or other such percentage as advertised). All discounts are applied at the time of purchase and cannot be combined with any other offers, discounts, or promotional programs, including staff discounts, unless expressly stated by Lush. Discounts are calculated before the application of sales taxes, which will be added at checkout.

9. Payment Methods

Payment may be made by credit card, debit card, or approved digital payment methods such as Apple Pay or Google Pay. Cash will not be accepted at the Sale. Lush gift cards will not be accepted.

10. Freshness Notice

Products sold in the Sale may be approaching the end of their freshness period under Lush’s Freshness Policy but remain safe for use. Customers acknowledge that the freshness of Sale products may differ from that of regularly priced items. Packaging may also be discontinued, limited, or not in its standard retail condition.

11. Returns and Faulty Products

All Sale products are final sale and sold as is. You may not return or exchange Sale products for any reason.

12. Collection of Purchases

All Sale products must be collected at the time of purchase from the factory location. Delivery, shipping, and later pick-up services are not available.

13. Resale Restrictions

Products purchased in the Sale are for personal use only and must not be resold or distributed for commercial purposes. You explicitly acknowledge and accept the prohibition on commercial resale set out in our Terms and Conditions. Lush may refuse or cancel transactions that it believes breach this condition.

14. Limitation of Liability

a) Subject to clause 14(b), Lush and its group companies accept no responsibility for any damage, loss, injury or disappointment suffered by any person as a result of their participation in the Sale, their attempted participation or their acceptance of any product.

b) Nothing in these Terms shall exclude Lush’s liability for death or personal injury as a result of its negligence, or for fraud or fraudulent misrepresentation, or for any other liability which may not be lawfully limited or excluded by law.

c) By participating or attempting to participate in this Sale, participants agree that Lush shall not bear any liability for: the loss, theft or misuse of any product; or any damage in any way attributable to this Sale or the attempted participation in this Sale, subject to clause 14(b).

15. Governing Law

These Sale Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

16. Amendments

We reserve our right to withdraw or amend this offer at any time without prior written notice and at our sole discretion. If we sell out of Sale products on the first day of this Sale, we may in our sole discretion not open the Sale on the second day.
